Should Michael Shields have been released?

After being granted a royal pardon Michael Shields has been released from prison.  If he has been released, then should the man who has allegedly confessed to the crime not be being investigated further?

    Michael Shields was granted a royal pardon by the Justice Secretary Jack Straw after a meeting with Mr Shield’s parents, Michael and Marie, at the end of August in which he was told that another man had confessed to the crime back in 2005. Although Mr Straw did not mention the man who is believed to have confessed to the crime in his statement, he is believed to be one Graham Sankey. If this is the case then should Mr Sankey not be serving some sort of jail time, and a full public enquiry be launched into why it has taken nearly four years for the evidence of the 2005 confession  to come to light?
