Ang asawa ko po sampu ng mga kasama nya ay i  ne enroll ng consultancy agency or Europhil sa isang eskwelahan na hindi na registrado para mag sponsor ng Foreign student. ito po ang website ng school sa UK, na kung saan ang aking asawa at ang iba pang naghahangad ng isang desenteng pamumuhay ay nabiktima." Healthcare Training Academy or HTA  ("healthcaretrainingacademy.com/" ) kami po ay nagbayad ng matrikula para sa isang taon pag aaral na may kasamang trabaho  or (OJT) with pay sa HTA sa pamamgitan ng EUROPHIL,  Subalit ang  aming visa po ay na deny ng British Embassy sa rason  na ang eswelahan na pinagenrollan ng consultancy  agency sa aking asawa kasama ang ibang applicante ay di na registrado. kami po nag demand ng refund sa aming tuition fee na nag kakahalaga ng 2,000 pound, o 172.000 pesos ng kami ay nag enroll noong September 2008. Ang visa refusal po ay lumabas lamang noong nakaraang Spet,28.2009 isang taon na paghihintay, Subalit ang agency po ay di na nag ooperate dito sa Ormoc ngunit may opisina cla sa Tacloban. Ang ibang kasamahan po ng asawa ko ay nagreklamo sa NBI Tacloban ngunit wala pong nangyari sa kanilang reklamo, ni hindi sumipot ang may ari ng agency. Dahil po magastos ang mag pabalik balik sa Tacloban para lang mag follow up sa reklamo, namatay pong kusa ang kaso. Ako po ay nag mamakaawa na sana po ay tulungan nyo kami na maimbestigahan ang Agency kung sino ang dapat managot sa amin mga applicante at  maibalik ang perang nagastos namin, Dahil po sa kahihiyan ng asawa ko at napasubo po kami sa mga utang cya po ay nag applay na Driver sa Damman Saudi Arabia, na sa kasamaang palad ang agency kanyang napag applyan ay Marvic  at isa rin pong illegal sa ngayon po ay isang buwan ng mahigit doon ang asawa ko  ay miserable ang kalagayan ngunit wala kaming magawa dahil nakpirma cya ng contrata at wala ring sweldo dahil salary deduction ang placement fee, Ako po ay nag dadasal at umaasam na mabigyang daan ang aking reklamo, Dahil kami ho ay nakalubog sa utang at walang linaw ang kalagayan ng aking asawa. Hindi lamang ako ang inyo matutulungan kung inyo bibigyan pansin ang aking reklamo kundi sampu ng iba pang mag applicante at magiging applicante ng EUROPHIL.CONSULTANCY AGENCY, ako ho at ang aking asawa ay gumawa ng mga pamamaraan na maibalik sa pammagitan ng pag email sa HTA at pagpunta ng personal sa kanilang opisina sa unit  415 , 4th floor Manila Bank Bldg,  Ayala Avenue , Makati CITY at may Telepono  8937456  ,  ngunit wala pong kasagutan ang lahat ng aming mga sulat. Ako po handa suportahan ang aking reklamo ng mga documento na makapagpapatibay sa aking mga reklamo, Ang tangi ko lang pong hangad at maibalik ang pera nagastos namin na bayad sa tuition fee ng school dahil di naman po nagamit ..  Lubos na umaasa at nag mamakaawa sa inyong  programa.

    I am writing and making a comment in behalf of EUROPHIL CMS INC. in connection with the email of Guest13786500
    9 months, 21 day(s) ago which indicted our company EUROPHIL CMS INC. and defaming us in writing quote and unquote "Hindi lamang ako ang inyo matutulungan kung inyo bibigyan pansin ang aking reklamo kundi sampu ng iba pang mag applicante at magiging applicante ng EUROPHIL.CONSULTANCY AGENCY," and to prove wrong her allegations herein that "deny ng British Embassy sa rason na ang eswelahan na pinagenrollan ng consultancy agency" because the said refusals were not based on the REASON THAT THE SCHOOL IS NO LONGER REGISTERED since we even have a client who was also APPROVED at the same time that the said spouse of the complainant is filed. And lastly, this is also to correct her imputations that the said office in Ormoc is already CLOSED since we are still OPERATING as of this date that this reply is publish.

    To probe deeper the history of the said complainant from Ormoc, the said couple applied with us first for an immigrant visa to Canada however, they find it more preferred to apply for student visa to U.K. instead because of the long processing time for the immigrant visa.  The processing procedure was done and the couple were explained the required documentations and they have signed a service agreement stating among others that the company DO NOT GUARANTEE ISSUANCE OF A VISA and that "No refund of any deposited amount to EUROPHIL will be made should there be changes in immigration laws however, they can be re-processed on any kind of visa they choose to shift at no additional costs at all except the embassy fee and other related expenses related thereto.  

    They signed and agreed to the said agreement after all details were explained in writing and they were also required to attend an orientation seminar for the said visa. They were assessed directly by the school HTA UK and tuition fees were paid directly to HTA UK. The school is LEGAL and REGISTERED under the DIUS registration which we have verified and check directly from said regulatory body prior to endorsement of the said school to the clients. The spouse of the said couple from Ormoc, completed his requirements and was lodged with the British Embassy in January 26, 2009.  While awaiting for their visa approval, however, the UK Immigration law implemented the PBS tier system and among this changes required by the embassy, educational providers and schools in U.K. are required to be REGISTERED with the UK Border Authority aside from the other point based requirements for the visa applicant to comply and this effectivity was set to March 29, 2009.  The said spouse of herein complaint is not covered of the said changes since they were filed with the British Embassy PRIOR to the effectivity of the said immigration change.

    However, the said spouse of the complainant's visa application was refused basically because of some policies that he failed to comply. One of which is that his skills does not justify the study for the said course that he is applying with HTA UK. Nothing was mentioned about the school being NOT REGISTERED. And the reason of the said complainant as alleged in the foregoing complain IS NOT AMONG THE REASONS OF THE REFUSAL, because, granting for the sake of argument that the said HTA UK is indeed NOT REGISTERED anymore, then why would the BRITISH EMBASSY accepted the lodging of the visa application in January 26, 2009 if indeed the school is not anymore REGISTERED. As a matter of fact, among those who motivated the Ormoc student visa applicants to file a complaint in NBI, is one of those who were granted a student visa to study with HTA U.K. which shows that the school is indeed legal since she was filed two (2) months after the said batch of the spouse of the herein complainant. But it came to our knowledge that she is the one who proded them ( the student visa applicants who were refused), to lodged a complaint with NBI which was not ACTED ON basically because of the fact that THEY WERE INDEED FILED WITH THE BRITISH EMBASSY hence, our job at EUROPHIL is DONE AND COMPLETED. The refusal of their visa is not anymore within our control as it is the decision of the reviewing consul that prevails.

    Hence, the above allegations herein of the said spouse of the complaint herein is NOT TRUE AND WAS MERELY BASED on her own and not legally grounded but merely made to damage our reputation because of her intention to malign us and put our company's name in jeopardy, which she strongly advised me that this complaint was send EXCLUSIVELY VIA EMAIL and NOT FOR PURPOSES OF PUBLICATION.

    It is therefore our ultimate concern that this blog be deleted and erased as this has caused already a lot of turmoil and doubts to our clients and clients to be whenever they make online search about our company online, this blog appear.  The said writer of this blog admitted to me to have written this but she told us that she sent this email directly to ABS CBN privately, however, to our prejudice and damage this was published here. It is our URGENT REQUEST that this blog be DELETED AND THAT THE AUTHOR BE CONTACTED DIRECTLY to CORRECT THIS IMPUTATIONS.

    Scam yang Europhil,I'm one of their clients and they give this so-called Term and Condition na No Refund. In your case you can't ask a refund for their services free but ung ikeep nila ung Tuition fee? Hindi pwede yun. It's not for them and they can't do that. They should give your money back. Kasi the School you enrolled will normally give your money back if your visa has been refused. Tingnan mo nangyari sa mga taong ginaganyan nila, nakakaawa, and then this couple the owner of Europhil CMS Inc; is now living in other peoples money.

    How many times we keep coming back in their office in Tacloban walang tao. but they still telling us na they still got an office there. And they still telling people na may opisina pa sila sa Ormoc. Can you imagine kung gano sila kayabang? To Guest13786500 pano mong nasabing Marunong na Filipina ung may ari ng Europhil? You talking about Rowena Varn Berne?.. I think meron lang syang qualifications but shes not educated enough, She can't even explain everything properly noh. Saka if she knew that your Husband is not qualified for this program na In-offer nila, so why she let your husband to apply or why she encourage you to pursue? The answer is kasi they know na marerefuse ung visa so they can keep all the money including the tuition fee.

    ABS CBN please stop them, they are Located in Manila now (as what as they said it's their another office) pero Palipat lipat sila ng lugar para makahanap ng new Victims. Maraming kaso si Rowena from when she was working for PNB bank and may kaso din sila sa DOLE. Marame nagreklamo but our case always been ignored kasi they got the undefeated Term and Condition na pinirmahan namin.  Naghihirap kame just to be able to go to other country para sa future naming but people like them are taking advantage of people like us. Pano pa kaya kung may mabiktima sila willing ibenta ung mga properties ditto sa Philippines? NAKAKAAWA……

    Also if you are a legitimate client of EUROPHIL, why dont you tell us your name so we can join forces together and contact me in Ormoc. I am the one who first posted this question but unfortunately our case was not acted on because WE HAVE A MEMORANDUM OF AGREEMENT which we signed and that put their name clear from all charges.


    I talk with some clients also, they were refused because they lack the necessary proof of funds and their intention to study were questioned by the Embassy. We are eight (8) student visa applicants for U.K and two were granted visa one is for the school of HTA under the name of Ms. Loreto and the other one is Ms. Matutina for SLC. I have verified with the schools and can say they are now in U.K per verification from the BID.  I can send to you their visas so you know and SLC can communicate with them.


    In fairness to the couple, they stick to their NO REFUND policy so as not to be abused and as well as that of the schools also in UK do not do any refund per the agreement that we have signed it is written there.


    In life, there is always risk in everything. I know a group of clients from EUROPHIL who got visa for U.S. and it was done legally, no promises of work or anything. They are working based on the NO GUARANTEE VISA. I know their office you can visit them both in Tacloban and Ormoc because I was just there last week to get a copy of my documents.


    I know there is a reason that we were not granted visas basically because it is not yet our TIME especially when we learned from this Ms. Loreto that the school in UK have been closed because it failed to comply with the requirements of the UKBA. So, where will we be if we were granted a visa?  I have blamed EUROPHIL before and being impulsive I sent this letter because I made investigation about the school or HTA but now I realizethat  they are not in the position to know all that is happening in UK nor in UKBA as it is even in their policy that EUROPHIL is not bound to any changes in IMMIGRATION LAWS during the process.  Now, I know why they were pushing us to comply with the documents as well as the requirements.


    Only GOD knows who is to be blamed but being JUDGEMENTAL and HATEFUL AS WELL AS VINDICTIVE is not CORRECT. Putting their names on air will put us all in trouble if the couple will make a complaint but knowing Weng and his husband, they even forgive me when I explained my side and provided them a screenshot of the email I sent to ABS CBN. I know now, why ABS CBN did not act on my complaint because the company of EUROPHIL is acting within the bounds of LAW as well as being a CORPORATION they have complied with what is right and proper to the eyes of GOd and their clients.


    It is my PUBLIC APOLOGY to the couple though it have cause them so much shame and bismerched their reputations, I believe their honesty and credibility is still within their company guidelines and policy.


    EVERYBODY has their own time of judgement before our Saviour and if you, all the guests who made their vindictive comments here, we have no right to TAINT the couple's reputation as well as their COMPANY. It is but proper that based on facts our comments as this is an online website and anybody can search this website especially that they are private persons doing business the proper way.


    Check with NBI how many visa scams they have arrested and the heaps of amounts involved by this people who made visa scams.  Europhil is doing their visa assistance in the right way only people misinterpretd the circumstances sorrounding the events that happened in the past years.

    Mario Van Berne and Rowena Van Berne are in hiding. They have issued bounced checks for almost all of their transactions. You can  check with BPI Bank, Fort Bonifacio in Makati . They have records to prove that they have issued checks without funds. Too bad, they cannot be trusted. So, please... do not be duped by them. They are out to mislead you and please check their file with NBI Tacloban. We shall post here their latest address so you can check it out . It is not true that they still have a branch as they claim in RCJ Building , Ortigas Pasig . NBI Manila has confirmed that they have issued 5 bounced checks with the owner of the place. Much less can this be considered as an offer to provide legal services or to advocate anything. It’s just one person’s opinion on a matter of increasing interest to bloggers and other denizens of cyberspace: what constitutes internet libel in the context of Philippine laws.

    How is libel defined under Philippine laws ? Article 353 of the Revised Penal Code defines libel as “a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status or circumstance tending to cause the dishonor, discredit or contempt of a natural or juridical person, or to blacken the memory of one who is dead”.

    For an imputation then to be libelous, the following requisites must concur: (a) it must be defamatory; (b) it must be malicious; (c) it must be given publicity; and (d) the victim must be identifiable.

    If you call someone a scum-sucking, slimeball, swindling pimp, even if this is fairly accurate, and post it online, you may be sued for making libelous statements.

    Defamatory words are those calculated to induce the hearers or readers to suppose and understand that that the person or persons against whom they were uttered were guilty of certain offenses, or are sufficient to impeach their honesty, virtue or reputation, or to hold the person or persons up to public ridicule. Philippine law also presumes every defamatory imputation to be malicious, even if true, if no good intention and justifiable motive for making it is shown (Article 254 of the Revised Penal Code). Malice exists when there is an intentional doing of a wrongful act without just cause.

    The libel must be given publicity, circulated or publicized. Postings in a forum, message board or blog can certainly be considered as publication. Lastly, the victim or offended party must be identifiable. What would be the liability of service providers for libelous acts committed by clients ?

    Under Republic Act no. 8792, otherwise known as the

    Electronic Commerce Act, a party or person acting as a service provider incurs no civil or criminal liability in the making, publication, dissemination or distribution of libelous material if: a) the service provider does not have actual knowledge, or is not aware of the facts or circumstances from which it is apparent that making, publication, dissemination or distribution of such material is unlawful or infringes any rights; b) the service provider does not knowingly receive a financial benefit directly attributable to the infringing activity; c) the service provider does not directly commit any infringement or other unlawful act and does not induce or cause another person or party to commit any infringement or other unlawful act and/or does not benefit financially from the infringing activity or unlawful act of another person or party (Section 30, in relation to Section 5, E-Commerce Law)

    Hence, a service provider should not be held liable if he has no actual knowledge of the libel, does not benefit financially from the unlawful act or does not directly commit the libelous act or induce someone to do so. Of course, once the service provider gains actual knowledge of the libel, timely steps must be taken, within the service provider’s authority, to remove the offending material by warning the perpetrator and, if all else fails, terminating the offender’s account. By acting speedily on the matter, the service provider shows good faith and that it does not condone the libelous acts.

    A fundamental sense of fairness and simple good manners and right conduct is usually enough to keep you, a good netizen, out of trouble.
