4Year Old Can Be Sued now, isn't that insane?

A judge has ruled that a young girl accused of running down a 87 years old woman while racing a bicycle with training wheels on a Manhattan sidewalk 2 years ago can be sued for negligence. Don't you think the judge is insane, how can he sue a 4 year old child.

    The Rule says that you can not sue a child under 4 and if they are above 4 then they can be sued. Since the kids are above 4 so they can be charged and their mother can also be charged for negligence.
