Are the international students eligible for the American opportunity tax credit?

A. No international students are not eligible for the American opportunity tax credit.  Only an American taxpayer who pays qualified tuition and whose gross income is $80,000 or less is eligible for the credit. Since the international students do not pay federal tax, they do not qualify for any government benefits, which includes education tax credits.

    According to the new IRS requirements  , the US does not provide exemptions or tuition waivers for international students and so international students are not eligible for the American opportunity tax credit . So the nonresident student and on visa status at any university in America, you will not receive a 1098T form and do not qualify for tax credit.
