The term adoption refers to a complete process through which the adopted child is permanently separated from his biological parents and becomes the legal child of his adoptive parents with all the rights, privileges and responsibilities that are associated with the relationship. Adoption of orphan, abandoned and surrendered children in India is governed by a set of instructions notified by Government of India.

In India, an Indian, Non Resident Indian (NRI), or a foreigner can adopt a baby.

There are special guidelines and documentation for each category of prospective adoptive parents. A single female or a married couple can adopt a baby. But on the same time, a single male is normally not eligible to be an adoptive parent in India. A single man wishing to adopt a child may be eligible if he applies through a registered organization. But in this case, he will still only be able to adopt a male child. In India there are few conditions for the adoptive parent should be medically fit and financially able to bear all the expenditure of a child.

Except for adoption by Hindus, Indian law has no arrangement for adoption. Children are kept under guardianship of adopting parents to leave the country, and adoption must carry out in the parents’ home country. During 2008, U.S. citizens adopted round about 307 children from India. In India Infants, young children and special needs children are available for adoption and usually these children are reside in orphanages. If any parent wants to adopt an older child, then the age of the parents may be relaxed accordingly.
