The DUI laws in the state of California also allow a judge or the jury to make two inferences about a person that may have been under the influence or at a rate of .08% or higher at the time of driving. If the evidence establishes beyond any doubt then that person provided a chemical test within the three hours of driving that was about 0.08 percent or more, judge or jury may, but is not required to, infer about the person that was under the influence of the alcoholic beverage at the rate of .08% or more at that time of driving. Despite of these permissible inferences, the defense is now allowed to present the evidence and argue that though an accused provided the chemical test within the three hours of driving which was about .08% or more, the blood alcohol level at the time of driving was less than .08% and so the accused is not guilty of violating the section.
Breath and the blood testing instruments are regulated by the Title 17 of California Code of the Regulations. Among the other things, these regulations normally require the breath testing instruments to be calibrated, i.e., it is checked for accuracy after every ten days, two breath test readings need to be obtained within the .02% of each other, then the person might be under continuous observation for other fifteen minutes prior to breath test, etc. Normally these regulations are not followed.
