In order to qualify for the adoption of a child from India, a family must first fulfill a home study with a registered agency. In a home study, a social worker analyzes a family's suitability through interviews and home visits. With an analyzed home study, the family may then register with an adoption agency that has been accepted by the Central Adoption Resource Agency of India Non-Indian families who wish to adopt will required to assemble a dossier documentation to be sent to the CARA. The Indian government uses a special protocol when giving children for adoption. First, CARA attempts to search an Indian adoptive family that has been proved legally available for adoption. If no family is available within 30 days, CARA gives a clearance certificate, which makes the child able for inter-country adoption. The agency searches a match family from among those who have applied to adopt and provided a complete dossier.

After a match has been take place and the adoptive family has taken the child, the family must petition the Indian court for guardianship. Adoptive parents must come before the court and sign the appropriate paperwork on this time. In this case if the adoptive parent wants to move in another country then the Indian adoption agency files for a passport and visa for the child. The adoptive parents take custody of the child after completing the entire paper work including visa and passport processing, is completed.
