Free Wi-Fi networks are common in today's' technological world. Free Wi-Fi access signals can be picked up by computers, cell phones configured for wireless access, palm pilot devices and pocket computers. These signals can originate from a residence or a place of business, such as a coffee shop, library or wireless communities. There are laws that pertain to accessing free Wi-Fi usage that can lead to fines and possible jail time if violated.

    Definition of Free Wi-Fi Network

    1. A free Wi-Fi network is a secure or unsecure network accessed by certain individuals and businesses who have received permission to operate on the network without incurring a cost or fee. In most cases, the individual or business receiving the free Wi-Fi signal has an affiliation with originating source providing free Wi-Fi access.

    Effects

    2. According to research from the Internet Business Law Services, most residential and business owners operate unsecured free Wi-Fi networks without knowledge of outside intrusion through hacking and unauthorized use. By allowing their networks to be compromised through lack of security, outside intrusion can cause problems to their free Wi-Fi network, which can lead to data loss, virus or damage to their operating system.

    Hacking

    3. Hacking is the act of breaking into a free Wi-Fi network with an attempt to modify or alter existing settings of a free secured or unsecured Wi-Fi network. This is performed by decoding the network key from which the free signal is originating. It is against the law to hack any network whether it is a free Wi-Fi network or a secure Wi-Fi network. The penalty for hacking into a free Wi-Fi network varies from state to state.

    Unauthorized Access

    4. Free Wi-Fi law addresses unauthorized access, which is the act or intent to intercept, retrieve, send or store data over a free Wi-Fi network without consent from a residence or a place of business. This is considered intrusion upon the owner's network and there are fines that can be levied against the intruder even though the Wi-Fi access is free.

    State Laws

    5. All 50 states have introduced or passed legislation pertaining to the issue of free Wi-Fi access. Each state has its own interpretation of the law of what constitutes intrusion or hacking into a free Wi-Fi network. Most state governments have created an office strictly dealing with information technology and laws that apply to the use of networks. This information can be found through the applicable state website.
