help with my rights?

i owe a company for a motorcycle i bought. my mother and i signed the paper work together. i lost my job and my dad, i tried working out payment plans and even offered to give the mothercycle back. they refused to help in any way and refused to take the motorcycle back. now they have sent my account to a company called penta group who is very rude and every kind of way. the motorcycle has benn totaled. i tried explaining to them that the bike was wrecked and i no onger have it can we work something out. the refused once again they have called and harrassed my mom and i to no end. i have sent a letter to stop all phone calls because of there rudness. what can i do about this situation please help

It may be their job but some of these guys are a******s in true sense, but there are laws on the matter. The main federal law in the U.S. is the Fair Debt Collection Practices Act ("FDCPA"). You can find it here: http://www.maybenow.com/Fair-Debt-Collection-Practices-Act-Summary-q19317972

Note what the law provides: the people cannot call at unreasonable time of the day, or contact you at unreasonable places. Also, they can only contact the debtor herself and her attorney -- they cannot contact other parties. Also, once the collection agency is contact in writing they must stop all contact (other than to say they will not contact you anymore).
